For the second time in as many years, the Family Medical Leave Act (FMLA) has expanded coverage for military personnel. As a part of the 2010 military appropriations bill, H.R 2647 – National Defense Authorization Act, signed by President Obama in October of 2009, the law is an amendment expanding FMLA to include families of active military members being called to duty in a foreign country.
FMLA went through major revisions in January, 2008. Among other things, FMLA was expanded to cover leave for qualifying exigencies for families of National Guard and Reserves. The January, 2008 law provides FMLA job protection to allow families to adequately manage their affairs before, during and after deployment.
As with the FMLA expansion of 2008, this latest round will go through a similar process of accepting feedback and writing of rules. How – and if – these new rules find their way onto a labor law posting and whether or not this will be required to post is yet to be determined. Even though the law became effective the date in which it was signed, October 28, 2009, It could take several months before content is written and released.
